Canature Watergroup Inc. (“we” or “us”) values our relationship with you and takes your privacy seriously. The purpose of this Privacy Notice is to identify how we may process, collect, store, share and use (collectively, “use”) the data that we collect from you in connection with your use of our [Aqua Alert™] products with [Aqua Alert™] sensor technology, our [Aqua Alert™] application and related software and services (collectively, our “Application”). This Privacy Notice also identifies your rights with respect to your personal information, all as described in more detail below.

We may update or modify this Privacy Notice at any time by posting the amendments on this page, including the effective date of the updated version. We will announce any material changes to this Privacy Notice by providing a notification upon login to our Application and posting a summary of material changes along with the date on this page. By accessing and/or using our Application, you accept and agree to the terms of this Privacy Notice and the use of your data and personal information as described in this Privacy Notice. If you do not agree to be bound by this Privacy Notice or any subsequent modifications, you should not access or use our Application or disclose any personal information through any of our Application.

Your privacy and the security of your personal information is, and will always be, important to us. We want to transparently explain how and why we gather, store, share, and use your personal information, as well as outline the controls and choices you have around when and how you choose to share personal information.

You can update your communication preferences and information in the following ways by: updating your contact information in your profile or account through our Application; managing push notifications on your mobile device through preferences in the Application or device settings; or contacting us at the e-mail or postal address below.

2. The information we collect about you.

The information we collect about you and your use of our Application can include personal information (as described below) or non-personal information, which is information that does not identify or relate to an individual.

Personal information is information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual, household or device (“personal information”). Personal information does not include publicly available information from government records, deidentified or aggregated information, or health or medical information.

When and how do we collect your information?

We collect information from you both when you provide it voluntarily and also automatically when you use our Application, depending on your Application settings. The personal information we receive relates to your use of our Application in connection with an [Aqua Alert™] product that you have purchased or use.

In some instances, we automatically collect certain types of information when you use our Application or correspond with us. Automated technologies may include the use of web server logs to collect IP addresses, “cookies” and web beacons.

You have choices when using the Application regarding whether your use of the Application automatically shares information, including personal information, with us. Please see settings available through the Application’s menu.

What information do we collect from you?

Account Registration Information This is the personal information that is provided by you or collected by us to enable you to login and access your account and our Application, should you choose to create an account. This includes your name, email address, password of your choosing, phone number, and address.
Account Usage Information This can be personal information and non-personal information that is collected about you when you are using our Application, and this may include:

  • Information about your interactions with our Application, which includes the data and time of any information you enter into our Application, and your interactions with our Application.
  • Technical data which may include cookie data, web beacons and other tracking technology information, your IP address, the types of devices you are using to access or connect to our Application, unique device IDs, device attributes, network connection type (e.g., WiFi, 3G, LTE, Bluetooth) and provider, geolocation data, network and device performance, browser type, language, and operating system.
  • This application collects location data to enable the Aqua Alert app to connect with your water conditioning system. Once the app has paired with your valve, you can disable the collection of location data by choosing "Ask Next Time" or "Never" in the Location Settings of the App (by clicking on Aqua Alert in your iPhone Settings). If the App loses connection with your valve (e.g. power outage), you will need to turn the location data back on before pairing the App with your system again.
  • Our Application may use cookies, unique identifiers and similar technologies to collect information about the Application functions that you access, the buttons and icons you click, and to remember your login information and Application settings to make it easier and more efficient for you to use our Application. You can choose whether to accept cookies by changing the settings on your browser or device. However, if you choose to disable this function, your experience with our Application may be impaired and some features may not work as they were intended.
Anonymized Information We use anonymized and aggregated information that may be created or derived from your personal information or usage of our Application for purposes that include data analysis, improving our Application, advertising, and developing new features and functionality within our Application.

3. How we may use your information.

We will only use your information for the purposes identified below, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose described here.

By using our Services and providing your contact information (including email address and/or telephone number), you expressly agree that we and our affiliates and partners, including promotional partners, may contact you at the email address and/or phone number you provide – including through an automated system, autodialed calls/text messages and/or pre-recorded messages regardless of your status on any State or Federal Do Not Call List. You understand consent is not a condition of purchase.

4. Who we may share your information with.

In connection with our Application, we may share your personal information with the following types of recipients for the following business purposes:

Service providers

We use service providers to operate our software and infrastructure, in particular providers which host, store, manage, and maintain our Application, its content and the data we process. This includes our email marketing, Application hosting, and information security service providers. When we share your personal information with service providers, it is subject to agreements with or obligations undertaken by such recipients that require them to keep your personal information confidential and not use it for any purpose except performing their agreements with us, where required by applicable law.

Aqua-Alert uses Jiguang Push to send push notifications to user devices. The JiguangPush privacy policy is available at https://www.jiguang.cn/license/privacy.

Dealers and Distributors We may share your personal information with dealers and/or distributors that service your area in order to provide service calls for your [Aqua Alert™] products to help them know who in their service area has used [Aqua Alert™] products, as well as monitor your [Aqua Alert™] products for metrics such as water usage, water level, leaks, salt level, or mechanical errors, and adjust programming for your [Aqua Alert™] product. Dealers may reach out to you via email and/or phone (to the extent you have provided your contact information in connection with using the Application or [Aqua Alert™] product) for service or support.
Data analytics providers We will share certain pieces of your Application Usage Information and Anonymized Information to create general data analytics regarding usage of our Application on an aggregate basis and without personal identifiers. For example, we use Google Analytics, a service provided by Google, Inc., to gather information about how you and other users engage with our Application. Law enforcement and government authorities We will share your personal information with third parties where required by law (including to respond to valid legal process such as a search warrant or a court order), where it is necessary in connection with our Application or where we have another legitimate interest in doing so.
Other legal or regulatory authorities We will share your personal information for us to comply with our legal obligations, including assessing compliance with our regulatory requirements (e.g., using Application usage information in the aggregate in connection with our regulatory requirements).
Buyer or successor of our businesss We will share your personal information with any buyer or successor in the event of a merger, reorganization, dissolution, or other sale or transfer of title.

Disclosures of Personal Information for a Business Purpose

In the preceding twelve (12) months, we have disclosed certain personal information for a business purpose, including:

We do not sell the personal information of users we actually know are less than 16 years of age, unless we receive affirmative authorization from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Our Application is not directed to children under the age of eighteen (18) years. See Section 9 “Children” below for more information.

Most, if not all, of the third parties with whom we may share your personal information are located and store your information in the United States, although some may store your information outside of the United States.

5. Your rights and options regarding your personal information.

You have choices about how we use your personal information to communicate with you, send you marketing information, and whether you want to stay signed into your account. You can opt out from receiving future marketing communications from us at any time by:

  • Using the unsubscribe function in the email you receive from us; or

  • Contacting us as set forth under “How to contact us” above.

In addition, as noted above in “The information we collect about you,” you can choose whether to share certain types of your personal information with us by changing the settings available through the Application menu and whether to accept cookies by changing the settings on your browser or device. However, if you choose to disable cookies, your experience with our Application may be impaired and some features may not work as they were intended.

You may select a “do not track” setting on your web browser. However, these features are not yet uniform, so we do not currently respond to such features or signals. Therefore, if you select or turn on a “do not track” feature in your web browser, we and our third-party providers may continue collecting information about your online activities as described in this Privacy Notice.

Depending on where you live, you may have certain rights with respect to personal information that we have collected and used under certain circumstances, which may include the following:*

  • The right to request the following information regarding our use of your personal information:

    • The categories of your personal information that we have collected

    • The purposes for which we have collected or used such personal information

    • The categories of sources for the personal information we have collected about you

    • The categories of third parties with whom we have disclosed your personal information

    • If we have disclosed your personal information for a business purpose, a list identifying the personal information categories that each category of recipient obtained

    • If we have sold your personal information, a list identifying the personal information categories that each category of recipient purchased

  • The right to receive a copy of your personal information.

  • The right to request us to erase your personal information when we no longer need such data in connection with our Application (subject to certain exceptions that may apply under applicable law).

  • The right to opt out of sales of your personal information. To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by visiting our Do Not Sell My Personal Information Page.

* If you are a resident of a jurisdiction where one or more of these rights are granted to you under applicable law, and you wish to exercise any such rights listed above, please contact us through one of the methods listed in under “How to contact us” above and for exercising the right to opt out of sales, you may also submit your request through the following link: Do Not Sell My Personal Information. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. Please understand that we are required to verify your request and may require you to provide some information to enable us to carry out such verification. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of Application that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us through one of the methods listed in under “How to contact us” above.

6. How we safeguard your personal information.

We have put in place appropriate security measures to reduce the risks of loss, misuse, unauthorized access, disclosure and alteration. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know.

While we are committed to protecting your personal information, please note that information communicated over the Internet is never 100% secure. Any transmission of personal information is at your own risk.

7. How long we store your personal information.

We may store your personal information as long as you use our Application and for legitimate business purposes.

We may store your personal information following completion of transactions with you to the extent required to comply with our legal, accounting, or reporting requirements. Additionally, we may continue to store your personal information contained in our standard back-ups.

Upon your request, we will delete or de-identify your personal information unless we are legally required or allowed to maintain such personal information.

8. Links.

Our Application may provide links to third-party websites that we do not control. We cannot be held responsible for third parties’ privacy practices or content provided on these websites. If you click on one of these links, please understand that you are leaving our Application and any information you provide will not be covered by this Privacy Notice. Please read that website’s privacy policy before providing any information.

9. Children.

Our Application is not directed to children under the age of eighteen (18) years. By using our Application, you represent that you are at least eighteen (18) years old. If you do not meet this age requirement, then you must not access or use our Application.

We do not knowingly collect information from children under the age of thirteen (13) years old. If you are under the age of thirteen (13) years old, please do not use our Application and do not provide any information to us. For more information about the Children’s Online Privacy Protection Act (“COPPA”), which applies to websites that direct their services to children under the age of thirteen (13), please visit the Federal Trade Commission’s website.

If you think we have collected information from a child under the age of thirteen (13) through our Application, please contact us through one of the methods listed under “How to contact us” above. If we learn that we have collected the information of a child under the age of thirteen (13) years old, we will take reasonable steps to delete such information.

10. Special notice to non-U.S. users regarding data transfers.

We store your personal information in the United States or other locations outside your home country. The privacy protections and the rights of authorities to access your information in these countries may not be the same as in your home country.

If you are located in a country outside the U.S. and submit personal information to us, you consent to the general use and disclosure of such information as provided in this Privacy Notice and to the transfer and/or storage of that information to the U.S. and other countries outside your home country.
